Cricket Wireless LLC (“Cricket”) licenses the myCricket Internet application (the “Application” or “App”) to You, conditioned upon your acceptance of this End User License Agreement (“Agreement” or “License”) for use with your Cricket 5G Home Internet service.
BY CLICKING “I AGREE” OR “ACCEPT”, OR BY DOWNLOADING, INSTALLING OR USING THIS APP, YOU: (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND AGREE TO ITS TERMS; (B) ACKNOWLEDGE THAT YOU ARE 18 YEARS OF AGE OR OLDER; (C) ACKNOWLEDGE THAT IN NO EVENT IS THIS APP TO BE USED BY PERSONS UNDER THE AGE OF 13; (D) AGREE TO ABIDE BY THE CRICKET ACCEPTABLE USE POLICY, cricketwireless.com/aup, (E) AGREE TO TERMS OF THE CRICKET PRIVACY NOTICE, cricketwireless.com/privacy, AND (E) AGREE TO THE TERMS OF THE MOST CURRENT CRICKET WIRELESS TERMS AND CONDITIONS OF SERVICE, cricketwireless.com/terms, (“Customer Agreement”) WHICH REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS, FULLY APPLIES TO YOUR USE OF THIS APP. IN THE EVENT OF A CONFLICT BETWEEN THIS LICENSE AND THE CUSTOMER AGREEMENT, THE APPLICABLE PROVISION OF THE CUSTOMER AGREEMENT SHALL CONTROL.

1. DEFINITIONS: (a) “Cricket,” “We,” “Our” and “Us” mean Cricket Wireless LLC and its parents, subsidiaries, affiliates, agents, employees, successors and assigns; (b) “App” means the myCricket Internet App, any website, software, content or services provided in connection with the App, and any updates to these items; (c) “You,” “Your” and “Licensee” mean an individual who downloads or uses the App and any person or entity represented by that individual.
2. THE APP: The App allows You to manage your Cricket Internet in home Wi-Fi network, including viewing what devices are connected to your network and may allow you to change your Wi-Fi network name and password. Se pueden aplicar tarifas de llamadas, datos y mensajes al usar esta Aplicación.
3. LICENSE GRANT AND USE RESTRICTIONS.
3.1 License Grant. Subject to the restrictions set forth in Section 3.2, Cricket grants You a personal, revocable, non-exclusive, non-transferable, limited right to install and use one copy of the App on a single device owned and controlled by You (“Device”), and to access and use the App on such Device, strictly in accordance with the terms and conditions of this License, and all applicable local, national, and international laws and regulations.
3.2 Restrictions on Use. You shall not: (a) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App, for any purpose; (b) modify, adapt, improve, or create any derivative work from the App; (c) violate any applicable laws, rules or regulations in connection with Your access or use of the App; (d) remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Cricket or its collaborators, suppliers or licensors; (e) use the App in a manner that derives revenue directly from such use, or use the App for any other purpose for which it is not designed or intended; (f) install, use or permit the App to exist on more than one Device at a time or on any other mobile device or computer; (g) distribute the App to multiple Devices; (h) make the App available over a network or other environment permitting access or use by multiple Devices or users at the same time; (i) use the App for creating a product, service or software that is, directly or indirectly, competitive with or in any way a substitute for any services, product or software offered by Cricket; (j) use the App to send automated queries to any website or to send any unsolicited commercial e-mail; (k) use any proprietary information or interfaces of Cricket or other intellectual property of Cricket in the design, development, manufacture, licensing or distribution of any Apps, accessories or devices for use with the App; (l) circumvent, disable or tamper with any security-related components or other protective measures applicable to the App or the Device or (m) reproduce, archive, retransmit, distribute, sell, lease, rent, exchange, modify, broadcast, synchronize, publicly perform, publish, publicly display, make available to third parties, transfer or circulate the App. You agree to abide by the rules and policies established from time to time by Cricket. 4. Use of Information.
4.1 Consent to Use Information.
You hereby authorize and consent to the collection, storage, and use, by Cricket and its affiliates, partners, suppliers, agents, subcontractors, and licensors of any information and data related to or derived from your use of the App or App Services, and any information or data that you provide (“Information”). Without limiting the generality of the foregoing, the Information shall include, without limitation, the following types of information and data, in an aggregate (not user level) form: search requests, search results, prompts, chat entries, chat responses, inquiries, patterns, data, and suggestions by or to user or based on user actions. Notwithstanding the foregoing, the Information shall not include any information or data that is personally identifiable to you. The Information will be treated as being non-confidential and non-proprietary, and Cricket assumes no obligation to protect confidential or proprietary information (other than personally identifiable information) from disclosure and will be free to reproduce, use, and distribute the Information to others without restriction. We are also free to use the Information and any ideas, concepts, know-how, or techniques contained therein for any purpose whatsoever including, without limitation, developing, manufacturing, and marketing products and services.
4.2 Privacy Notice.
You represent that you shall comply with the terms and conditions of the Cricket Privacy Notice, available at cricketwireless.com/privacy, which sets forth and describes the practices of Cricket with respect to the collection, use, and disclosure of Information in connection with your use of the App and App Services. Cricket reserves the right to change the provisions of its Privacy Notice at any time and from time to time at its sole discretion. Cricket will post any changes to its Privacy Notice at cricketwireless.com/privacy. Your use of the App and App Services following the posting of such changes to the Privacy Notice will constitute your acceptance of any such changes.
5. INTELLECTUAL PROPERTY RIGHTS.
5.1 Rights to App. The App (including its source and object code), any copies thereof (whether or not present on Your Device), and all copyrights, patents, trademarks, trade secrets and other intellectual property rights associated therewith are, and shall remain, the property of Cricket or its collaborators, licensors, or suppliers. 7. DISCLAIMER OF WARRANTIES. ADEMÁS, CRICKET Y SUS COLABORADORES, PROVEEDORES Y CONCEDENTES DE LICENCIAS NO DAN GARANTÍA ALGUNA DE QUE (I) LA APLICACIÓN SATISFARÁ SUS REQUISITOS; (II) LA APLICACIÓN SERÁ ININTERRUMPIDA, PRECISA, CONFIABLE, OPORTUNA, SEGURA, LIBRE DE VIRUS U OTROS COMPONENTES PERJUDICIALES O LIBRE DE ERRORES; (III) LA CALIDAD DE LOS PRODUCTOS, LOS SERVICIOS, LA INFORMACIÓN U OTRO MATERIAL AL CUAL USTED ACCEDA U OBTENGA A TRAVÉS DE LA APLICACIÓN SERÁN ACORDES A LO DESCRITO O CUMPLIRÁN CON SUS EXPECTATIVAS; O (IV) CUALQUIER ERROR EN LA APLICACIÓN SERÁ CORREGIDO O LA APLICACIÓN RECIBIRÁ MANTENIMIENTO. You acknowledge that the App IS not intended or suitable for use in situations or environments where the PERFORMANCE OF, USE OR misuse of, failure of, or errors or inaccuracies in the content, data or information provided by, the App could lead to death, personal injury, or severe physical, property, or environmental damage. SALVO QUE LO PROHÍBA LA LEY, BAJO NINGUNA CIRCUNSTANCIA CRICKET, SUS COLABORADORES, PROVEEDORES O CONCEDENTES DE LICENCIAS, NI TAMPOCO SUS FUNCIONARIOS, DIRECTORES, EMPLEADOS Y AGENTES, SERÁN RESPONSABLES POR ACCIDENTES, DAÑOS A LA PROPIEDAD, LESIONES PERSONALES, MUERTE, O POR CUALQUIER DAÑO INDIRECTO, INCIDENTAL, CONSECUENTE, PUNITIVO, ESPECIAL O EJEMPLAR QUE SURJA DE O EN CONEXIÓN CON LA VENTA O DISTRIBUCIÓN, EL RENDIMIENTO O NO RENDIMIENTO, O SU ACCESO O USO O INCAPACIDAD DE ACCEDER O USAR LA APLICACIÓN, YA SEA QUE LOS DAÑOS SEAN PREDECIBLES O NO Y YA SEA QUE DICHA PARTE FUE ADVERTIDA O NO DE LA POSIBILIDAD DE DICHOS DAÑOS. SIN LIMITAR LA GENERALIDAD DE LO ANTES MENCIONADO, LA RESPONSABILIDAD GLOBAL DE CRICKET ANTE USTED (YA SEA BAJO CONTRATO, PERJUICIO, ESTATUTO O DE CUALQUIER OTRA FORMA) NO SUPERARÁ (i) EL PRECIO INICIAL DE COMPRA QUE USTED PAGÓ POR LA APLICACIÓN, (ii) LA CANTIDAD TOTAL QUE PAGÓ A CRICKET POR LA APLICACIÓN DURANTE EL MES ANTERIOR A LA FECHA EN QUE SE HIZO LA RECLAMACIÓN, O (iii) DOS DÓLARES ($2.00). 9. INDEMNIFICATION. This License shall be deemed to take place in the State of Texas and shall be governed by and construed in accordance with the laws of the State of Texas, excluding its conflicts of law principles. 10.5 Export Control; Lawful Use. You may not export or re-export the App except as authorized by United States law and the laws of the jurisdiction(s) in which the App was obtained. To the extent not prohibited by law, Cricket may modify or amend the terms of this License at any time, with or without direct notice to You, by posting a copy of the modified or amended License available through the App or at att.com. 10.12 Entire Agreement.
