Los Términos y Condiciones de Servicio de Cricket Wireless se han actualizado.
Novedades
Here is a summary of a few highlights, but please read the entire agreement carefully. We’ve streamlined and updated sections 1.3 and 1.12, which outline where and how we’ll resolve any disputes that may arise between us.
Section 1.3.
As before, the Informal Dispute Resolution and Arbitration provision requires that most disputes will be handled informally, in small claims court, or by individual arbitration and not by a jury trial or class action.
- Arbitration Provider Change. For claims that go to arbitration, you and Cricket will now use JAMS, rather than the American Arbitration Association, to administer arbitrations under JAMS Streamlined Rules, as modified by our agreement. JAMS is an established provider of arbitration services known for including a high number of former judges on its roster of experienced arbitrators. For more information about JAMS, go to jamsadr.com or cricketwireless.com/legal-info/arbitration.html.
- Updated Procedures for Administration of Coordinated (Mass) Arbitrations. If your claim is part of a group of 25 or more similar claims by customers with the same or coordinated lawyers, you and Cricket will now have the option to move the dispute to court instead of continuing in arbitration. That option gets triggered if the dispute has not been resolved or withdrawn after two rounds of individual arbitrations and mediations described in subsection 1.3.2.7.
Section 1.12 of the Cricket Wireless Terms and Conditions of Service now addresses where and how we’ll handle disputes in court. It provides that existing individual-dispute procedures, including class-action and jury-trial waivers, also apply if a dispute is resolved in court instead of arbitration. That means:
- Expanded class action waiver. To the extent permitted by law, all disputes, whether in arbitration or court, must be brought on an individual basis and not as part of a class, collective, representative, or similar proceeding.
- Jury trial waiver. To the extent permitted by law, you and Cricket waive the right to a trial by jury.
